Conflict resolution and problem solving approaches rooted in tradition and custom can be a barrier to innovation, creativity and progress which are all the hallmarks of successful conflict resolution processes.

So, what am i thinking about in particular? Well, mediation processes, if the truth be told. If the starting premise is that most separating couples and families are best served by outcomes which require them to reach their own agreements should we not start with the questions;

What kind of thinking, approach and process(es) are most likely to lead them to this outcome ? AND

Does this lie in the more traditional legal adversarial solicitor led approach and court based intervention or in a more facilitative, fluid, creative approach which emphasises and encourages empowerment, self determination of the individuals?

If the latter, surely what follows is an opening up of the mind to new and creative possibilities in both approach to the problem solving and the outcomes which meet the individuals needs and interests

What follows is a period of positive innovation and change which we are currently experiencing in this country in the field of conflict resolution but there is still much work to be done in spreading the word because ‘old habits die hard’ and so many still gravitate towards the court for historical and psychological reasons.

We need to focus on persuading those self represented individuals to give mediation ago where it is judged suitable. They never know they may be able to sort things out for themselves and save thousands of pounds.
