What is mediation ?
This afternoon, the Family Mediation Week came to an end with a webinar hosted by the excellent Karen Barnham, in conversation with Mavis Mc Clean.
A number of fascinating topic were discussed and points raise.
The topic covered in this article relates to the Branding of mediation or, put another way, how well the mediation process is understood by the general public.
I was surprised to hear Mavis McClean express the view that there is still a great deal of misunderstand about mediation and its aims.
This brief article is my attempt at some messaging and branding for family mediation which you are very welcome to use although I am sure that you have your own branding and messaging, which is already very effective.
Have you separated, do you need help to work out a fair agreement with your Ex ?
What should you do next?
The aim of mediation is not conciliation, reconciliation (although very occasionally this may be an outcome) or marriage guidance.
If you come to mediation you can expect the following:
- Help from a family mediator to resolve problems with your Ex as a result of your separation- financial and children
- A clear framework and structured process, with a clear pathway to follow
- Clear information about the law applying to your situation from the start.
- Help with understanding the law and how to apply it to your situation
- Support to communicate and work with your former partner to problem solve together
- A safe and secure environment for your views, wishes and concerns to be heard and understood
- Fair financial solutions which meet the priority needs of your separated family
- A process which promotes self determination rather than others making decisions about you and your situation.
- Help with obtaining any additional expert advice and support you and your Ex may need to problem solve together, delivered in a co-ordinated, efficient and cost-effective way.
Having practiced as a collaborative solicitor, mediator and divorce coach for many years my preferred approach, and one I find works for me and my clients most of the time, is a cohesive co-ordinated team problem solving approach, carefully managed by a mediator (an expert facilitator and conflict management communication specialist), helping the separating couple to problem solve together, working with the right professional for the right task, at the right time in the process-in the most efficient and cost effective way.
